Terms of use and sale

1. What qkt Labs is

qkt Labs is an independent publisher of trading research and software. Each listing is a trading strategy written for the open-source qkt engine, together with the results of an automated test process: tick-level backtests, an out-of-sample test, walk-forward re-testing, cost stress and the other checks described on the How the research works page.

What you buy is research and a software file, and nothing else. qkt Labs is not:

• an investment adviser, financial adviser, broker, dealer or fund;
• a signal, copy-trading or account-management service;
• a source of personal recommendations about what you should buy, sell or hold.

2. No promise of profit

qkt Labs makes no promise, guarantee or representation that any strategy will make money, will perform as it did in testing, or will not lose money. Every figure on this site is from historical simulation. Simulated results have inherent limits: they are produced with the benefit of hindsight, they do not involve real money being at risk, and they cannot fully account for liquidity, execution delays, broker conditions and market changes. No representation is made that any account will or is likely to achieve profits or losses similar to those shown. Past performance, simulated or real, is not a reliable indicator of future results.

3. Not advice

Nothing on this site, in a strategy, in a research paper, in a review or comment, or in any message from us is investment, financial, tax or legal advice, or a recommendation to trade any instrument. Research is general and educational. You alone decide whether, how and with how much money to use it, and you should consider your own circumstances and seek independent advice where appropriate.

4. Your responsibility

• You are responsible for every trade placed on your accounts, manually or by software.
• You should test any strategy on a demo account before risking real money.
• You are responsible for complying with the laws that apply to you, including any restrictions on trading leveraged products such as CFDs where you live.
• You must be 18 or older and legally able to enter into this agreement.

We provide research, data and know-how. The decision to use any of it is yours, and so are its consequences. Buying, downloading or running a strategy is never a recommendation to trade, and we are not responsible for what you decide to do with it.

5. What a purchase includes

A one-time purchase gives you a personal, non-exclusive, non-transferable licence to use the strategy file for your own trading, the full test evidence, the research paper, and every future version of that strategy. Free sample strategies come with the same licence at no charge.

• Use it on accounts you own or control.
• Do not resell, share, publish or redistribute the strategy file, its reports or its paper.
• Each copy is marked to its buyer so that leaks can be traced.

The open-source tools a strategy runs on (qkt, mt5-gateway and qkt-insights) are published by their authors under their own licences, which govern their use; buying a strategy does not change those licences.

6. Prices and payment

Prices are shown before you pay and are charged once, by our payment provider. Because a strategy is digital content delivered as soon as you pay, all sales are final and we do not offer refunds. This does not affect any rights you have by law that cannot be excluded.

7. Accounts, reviews and comments

You sign in with your Google account. Only buyers can review a strategy; anyone signed in can comment. Do not post anything unlawful, abusive, misleading, or promotional, or anyone’s personal information. We may hide posts that break these rules; we do not edit what you write.

8. Liability

To the fullest extent the law allows, qkt Labs is not liable for any trading loss, lost profit, or indirect or consequential loss arising from using a strategy, the research, the site or the open-source tools, and our total liability for any claim is limited to the amount you paid for the strategy concerned. Nothing in these terms limits liability that cannot be limited by law.

9. Changes

We may update these terms. The version you agreed to is recorded with each purchase; changes apply to purchases made after they are published.

10. Provided as is

Strategies, research, reports and the site are provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, completeness, or that they are free of errors. Software has defects: the strategies, the qkt engine, mt5-gateway, qkt-insights, your broker’s platform and your own computer can all contain or cause errors that lead to unexpected orders or losses. You run them at your own risk and are responsible for supervising them.

11. Test data and results

Results are produced from historical market data supplied by third parties and from a cost model (commission, spread, slippage and swap) chosen for testing. That data can contain gaps or errors, and the cost model will differ from your broker’s. We do not warrant that any figure is accurate, and we may correct or restate a figure if we find an error. A figure that is later corrected is not a ground for a refund of any amount, loss or lost profit.

12. What you post

You keep ownership of your reviews and comments. By posting you give qkt Labs a free, worldwide licence to display them on the site, and you confirm you have the right to post them. We may remove anything that breaks section 7.

13. Suspension and ending access

We may suspend or end your account or access to a strategy if you break these terms, share or resell files, use the site unlawfully, or if a payment is reversed, disputed or charged back. We may also do so where required by law. Clauses that by their nature continue (including sections 2, 3, 4, 8, 10, 11 and 15 to 18) survive.

14. Where this is offered

The site is not directed to anyone where offering or using it would be unlawful, and you must not use it if you are a person or entity subject to sanctions. You are responsible for confirming that buying and using trading research is lawful where you live.

15. Your promise to us

To the extent the law allows, you agree to cover qkt Labs for claims, losses and costs that arise from your breach of these terms, your use of a strategy, or what you post.

16. Availability

We try to keep the site running but do not promise it will always be available or uninterrupted. We are not liable for failures or delays caused by events beyond our reasonable control, including outages of hosting, payment, sign-in or data providers, network failures, and changes by exchanges or brokers.

17. Taxes

You are responsible for any tax that applies to your purchase and to your trading, and for reporting it.

18. Governing law and disputes

These terms are governed by the laws that apply where qkt Labs is established, and the courts there have jurisdiction, except that any mandatory consumer protection of the country where you live still applies. Before starting a claim, write to us at labsupport@qkt.com and give us 30 days to put it right.

19. General

These terms and the Risk disclosure and Privacy policy are the whole agreement between you and us about the site. If a part is unenforceable, the rest still applies. Not enforcing a right is not giving it up. You may not transfer your rights under these terms; we may transfer ours to a successor of the business.
